Divorce

If ending your marriage is something that you or your spouse might be considering, it is absolutely imperative that you have someone assist you whom is extremely knowledgeable in the issues and laws that may be relevant throughout your divorce.

Child Support

Though the majority of child support cases are fairly cut and dry, determination of child support can be challenging without the assistance of competent legal representation when there are other extenuating circumstances involved.

Child Custody & Timesharing

Like other areas of domestic relations, there is simply no “one size fits all” approach to matters pertaining to children including custody and timesharing.

Domestic Violence

With the modifications of Kentucky law in the beginning of 2016, the Courts power to protect individuals from domestic violence has greatly expanded.

Does Kentucky presume joint custody and equal timesharing?

Yes. Kentucky law now presumes that joint custody and equal timesharing serve a child’s best interests. However, this presumption is rebuttable — meaning it does not automatically apply in every case. Facts such as a parent’s fitness, the child’s needs, and each parent’s history of involvement can lead a court to order a different arrangement. Our attorneys can help you understand how this presumption may apply to your specific situation.

Can a child custody or timesharing order be changed later?

Yes. Custody and timesharing arrangements are not permanent. Because a family’s circumstances — and a child’s needs — change over time, Kentucky courts allow these orders to be modified when a change serves the child’s best interests. If your current arrangement is no longer working, we can help you evaluate whether a modification is appropriate.

Do I need a lawyer for an uncontested divorce in Kentucky?

While Kentucky doesn’t require an attorney for an uncontested divorce, having one helps ensure the settlement agreement is drafted correctly and protects your interests — especially where property, debt, or children are involved. Osborne Family Law PLLC assists with uncontested divorces involving minimal or no financial complexity, as well as highly contested divorces with significant assets.

What does a Kentucky divorce actually involve?

A Kentucky divorce (legally called a “dissolution of marriage”) typically addresses the equitable division of marital assets and debts, spousal maintenance, and — when children are involved — custody, timesharing, and child support. The process can range from a straightforward uncontested filing to a lengthy contested case involving complex finances.

What's the difference between divorce and legal separation in Kentucky?

A legal separation allows spouses to formally divide property, address support, and resolve custody matters without dissolving the marriage. Some couples choose it for religious, financial, or personal reasons, or as a step before deciding whether to pursue a full divorce. An attorney can walk you through which option fits your circumstances.
